Terms & conditions of rental

1. Purpose and acceptance

These terms govern access to and use of the GridRyde platform, owned by More Solutions Málaga Consulting S.L. ("GridRyde"), as well as the booking and rental of items through it.

By registering, booking or using the platform you accept these terms. If you do not agree with them, do not use the service.

2. What GridRyde is and who the parties are

GridRyde is a platform that connects those who offer items for rent (the "providers"; for example, a empresa offering bikes to its guests) with those who want to rent them (the "customers"). GridRyde handles registration, booking, payment, deposit and, where the item allows it, its unlocking and location.

The rented item is made available by the provider. GridRyde acts as a platform that facilitates and intermediates the transaction and provides the associated technical and payment services.

3. Registration and user requirements

  • You must be of legal age and have legal capacity to enter into contracts.
  • You must provide truthful data and keep it up to date.
  • You are responsible for keeping your credentials confidential and for the use made of your account.

4. Bookings and formation of the contract

You make a booking by selecting the item, date and conditions shown. The booking is only confirmed once payment has been successfully completed.

Before confirming you will see the price, duration, deposit (if any) and the applicable cancellation conditions.

5. Prices, payments and deposit

  • Prices are shown before you confirm the booking and include applicable taxes.
  • Payment is made at the time of booking through our payment provider (Stripe). GridRyde does not store your full card details.
  • For certain items we may hold a deposit (pre-authorisation) that is released after the item is returned correctly. The deposit may be applied in whole or in part in the event of late return, damage, loss or breach.
  • If you return the item late or outside the indicated area, charges may apply, which you will see reflected in your booking.

6. Identity verification

For certain rentals or deposits we may ask you for an image of an identity document for the sole purpose of verifying your identity. That image is deleted when the rental ends. See the Privacy policy for details.

7. Use of the item and customer obligations

  • Use the item diligently, in accordance with its nature, the instructions provided and the applicable regulations.
  • Do not transfer or sublet the item to third parties.
  • Respect the date, duration and use/return area indicated in the booking.
  • Report immediately any incident, breakdown, damage, loss or theft.
  • Where the item has a lock or device (for example, Bluetooth unlocking or geolocation), follow the usage instructions and do not tamper with the device.

8. Pickup and return. Late returns

Pick up and return the item at the place, date and area indicated. Returning it late or outside the established area may generate late charges and, where applicable, use of the deposit.

9. Cancellations and refunds

  • You may cancel your booking according to the cancellation policy shown at the time of booking.
  • Any applicable refunds are made through the same payment method used (Stripe).
  • If you purchased cancellation insurance or a guarantee, its specific conditions will apply.

10. Damage, loss or theft

You are responsible for the item during the rental period. In the event of damage, loss or theft attributable to improper or negligent use, you may be liable for repair or replacement costs, which may be deducted from the deposit or claimed through appropriate legal means.

11. Liability

  • GridRyde provides the platform and the booking and payment services with due diligence, but does not guarantee uninterrupted availability nor freedom from technical errors or interruptions.
  • The provider is responsible for the condition, safety and maintenance of the item it makes available.
  • GridRyde is not liable for damages arising from improper use of the item by the customer or from force majeure.
  • None of the above limits the rights granted to consumers on a mandatory basis by consumer law.

12. Prohibited conduct and suspension

You may not use the platform or the items for unlawful, fraudulent or non-compliant purposes. GridRyde may suspend or cancel your access in the event of serious breach or fraudulent use.

13. Intellectual property

The platform content (text, images, trademarks, logos, software and design) belongs to GridRyde or to third parties who have authorised its use, and is protected by intellectual and industrial property law. Its reproduction or use without authorisation is prohibited.

14. Data protection

The processing of your personal data is governed by our Privacy policy, which forms part of these terms.

15. Right of withdrawal (consumers)

As this is a rental service for a specific date or period, the 14-day right of withdrawal provided for distance contracts may not apply (art. 103.l of the consolidated text of the Spanish General Law for the Defence of Consumers and Users). Instead, the cancellation policy of your booking applies.

16. Changes

We may update these terms to adapt them to legal or service changes. The current version is published on this page with its update date; the terms in force at the time of booking apply to your booking.

17. Applicable law and dispute resolution

These terms are governed by Spanish law. If you are a consumer, you may bring proceedings before the Courts of your domicile.

18. Specific conditions for private (individual) providers

A «private provider» is a natural person who offers their own goods for rent through GridRyde, without acting as a business.

By listing an item, the private provider declares that they own it or are entitled to rent it, that it is in good condition and complies with applicable regulations, and that it is fit for the intended use.

GridRyde acts as an intermediary: the rental contract is entered into between the private provider and the customer. GridRyde provides registration, booking, payment, deposit and technical support services, and retains a 20% commission on each rental, with no monthly fee.

Tax obligations: the private provider is solely responsible for declaring the income they earn (generally as movable capital income in their personal income tax return). GridRyde provides them with an income statement and, as a platform, reports the seller information required by law to the Spanish Tax Agency (DAC7 / Form 238).

Liability: the private provider is responsible for the condition, safety and legality of the goods they offer. GridRyde limits its liability to the proper provision of the intermediation services, under clause 11.

Motor vehicles: for the time being, the rental of cars, motorcycles or other motor vehicles by private providers is not allowed. It will only be enabled once GridRyde has the specific insurance required for peer-to-peer rentals.
